The Failure of the 28-Clause Ceasefire Plan for Ukraine: Why Peace Negotiations Continue to Falter

Europe felt a moment of respite on Monday, as the diplomatic emergency triggered by the announcement of a new comprehensive peace framework for resolving the conflict appeared – temporarily – to have been defused. A Washington representative spoke of "substantial progress" after bilateral negotiations in Geneva. On Monday night, Russian leadership made its response: another massive barrage of aerial bombardment on Kyiv.

The Rhythm of Diplomacy and Destruction

The chain of opposing developments captured the grim essence of the recent timeframe. By day, diplomatic battles are conducted: hopeful statements are released from various governments. Significant resources is allocated on restraining particular approaches. By night, Russian leadership clearly shows the world that, for them, conflict continues to be the main instrument for achieving "peace".

After-Dark Attacks

As military strikes progressed into the early hours of Tuesday, the present situation of Ukraine's exposure was exposed. Ukraine is equipped to monitor projectile deployments from enemy soil, a ability enabled by timely intelligence. From observation points, defense planes that had been dispatched to counter approaching cruise missiles streaked across the sky – modern combat jets provided to Ukraine by NATO members.

Shortly after, Kyiv's air-defence systems activated: multiple launches deployed against a Russian ballistic missile. This was a modern interception technology at work, presumably delivered by partner states. Every firing shakes the surroundings, shaking the windows. The instant of fear quickly becomes resigned acknowledgment: perhaps the approaching threat won't hit its mark this time, sparing the city from catastrophe and another blackout.

Continuous Dangers

Soon after, a heavy machine gun fired at a drone somewhere nearby, part of a mobile-fire group – most likely allied-provided weaponry. Sadly, the bullets missed the hostile drone – it pressed on overhead toward its destination.

Intermittently, this persisted until dawn. Kyiv awoke to the daybreak reports: multiple fatalities, devastation and infrastructure problems in multiple buildings as a result of the evening attack. As typically, everyone still went about their day – enduring hostilities. But those full day demonstrated Ukraine's essential dependence on international aid – a dependence that European nations are clearly incapable to fill in the immediate future.

Ineffective Peace Efforts

The detailed framework from US administration generated strong feelings, controversy and serious worry – and momentarily shifted focus from Ukraine's most significant graft case in years. Yet, we have experienced comparable situations, after prior negotiation attempts and international summits.

Every new approach from American administration adheres to the consistent cycle: a political offensive against Ukraine, which Kyiv, with allied governments, succeeds in resisting. They stabilise the situation but never actually win the battle. This trend will, certainly, endure.

Strategic Calculations

It is easy to blame certain parties of persistently promoting Moscow's conditions. But that does not seem to be the whole story. US administration operates on a assumption well known to seasoned negotiators: you cannot win at the negotiating table what you have lost on the battlefield. The US administration presumes that it is impossible to pressure the Kremlin to surrender the land that it currently occupies in Ukraine's south or east.

The issue is that while recognising this factual reality, American administration does little to prevent Kremlin actions, through diplomacy or military means, from thinking that the status quo will not shift further in its benefit in the near future.

Opposing Positions

Therefore, Russian leadership is convinced that the clock favors them – that Ukraine and its supporters are approaching exhaustion. Their incentive to sign a deal that does not give them the maximum possible gain is almost completely absent. There may be numerous efforts to stop fighting, but they will continue as long as Russia's leadership remains highly assured in the result.

On the contrary, Ukraine's government believes that Ukraine can still hold out, progressively conceding civilians and areas but avoiding a total frontline collapse until circumstances change in its benefit.

Present Conditions

Realistically, there are no real preconditions for a ceasefire. Now, subjective factors are entering the equation: political desires to mediate resolution and obtain worldwide acknowledgment, and the government's twin challenges – on one hand, not to estrange crucial supporters, and on the other, to unite the population around the country's interests against any initiative Kyiv finds unsuitable, so that their attention does not shift toward domestic problems. And although their objective will now be significantly challenging after latest incidents, it remains quite doubtful that this will modify their basic position.

These two forces are guiding negotiations.

Conclusion and Outlook

It took a just a single week to eliminate the 28 points of the most recent proposal. Forceful and unpredictable management of the matter by American leadership, opposition by Ukraine and the rest of Europe, along with soothing efforts of negotiators, and finally, current information leaks, all did their job.

While new proposals based on previous concepts are forthcoming, Kyiv, London and other allied nations should reach an essential realization: Ukraine and Europe will only be able to fend off diplomatic offensives from Washington that are founded on Moscow's terms and reflect specific hesitation to modify developments, if they maintain solidarity and improve their protective measures at a much faster pace. If they do, neither political nor armed coercion will be able to defeat them. In the meantime, Ukraine's capacity to counter nocturnal attacks will, for the foreseeable future, primarily depend on ongoing international assistance.
